Terms of service

The terms on which FusionX Media Ltd provides Meritfold during the founding-partner period.

The service

Meritfold monitors published UK public-sector notices, scores them against the evidence your organisation has approved, and drafts bid responses from that evidence. It is decision-support software: it prepares material for your team to review, edit and submit.

What Meritfold does not do

  • It does not submit anything to a buyer or a procurement portal. Submission stays a deliberate act by your team.
  • It does not guarantee that you will win any contract, or that a notice it scores highly is right for you.
  • It does not replace professional bid, legal or commercial judgement. Every consequential decision is yours.

Output must be reviewed by a person before it is submitted. Drafted text is generated from the evidence you approved, and the accuracy of that evidence is your responsibility.

Your account

You are responsible for the security of your credentials and for the actions of users you invite to your workspace. Tell us promptly if you believe an account has been compromised.

Your content

You keep all rights in the documents and evidence you upload. You grant us only the permission needed to operate the service for you: to store, process and generate material from your content on your instruction. We do not use your content to train models, and we do not share it with other customers.

You confirm you have the right to upload what you upload, including where it contains personal data such as staff CVs.

Acceptable use

Do not use Meritfold to misrepresent your organisation’s capabilities or experience, to upload content you have no right to, to attempt to reach another customer’s data, or to disrupt the service. The product is built to make fabricated claims difficult; using it to make them anyway is a breach of these terms.

Founding-partner period

Meritfold is early-stage software. During this period, features may change, and we do not offer a contractual uptime guarantee. Creating a workspace and reviewing scored opportunities is free. Any paid pilot is a separate written scope agreed with you in advance, with no annual commitment and no automatic renewal.

Ending it

You can stop at any time. You can export your entire workspace yourself, from Settings, whenever you want. Deleting a workspace is run by us rather than exposed as a button, so that an account cannot be destroyed while work is open: ask us and we will delete it and confirm when it is done, within one month of the request. We may suspend an account that breaches the acceptable-use section, and we will tell you why.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for lost profits, lost contracts, lost bids or indirect losses, and our total liability is limited to the amount you have paid us in the twelve months before the claim.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
